WHS duties

The WHS Act places work health and safety duties on:

Persons Conducting a Business or Undertaking (PCBUs)
officers
workers
other persons at a workplace.

WHS duty is often referred to as a 'duty of care'. The person who owes a duty of care is a 'duty holder' and their duties generally apply to the extent to which they have control over a matter.

To put this into context, DPS is a PCBU with a duty of care towards officers, workers and other persons at DPS. Let’s explore this further.
